Atty. Trixie Cruz-Angeles has met with raised eyebrows ABS-CBN’s claim that the quo warranto case filed by Solicitor General Jose Calida is not an attack on press freedom as ABS-CBN wants the public to believe.

In a Facebook post published just recently, Angeles offered a simplified explanation debunking ABS-CBN’s use of press freedom card.

According to her, ABS-CBN still enjoys the freedom to speak and express as an organization. Angeles elaborated that the news network can still publish, write news, create art etc..

The only thing they cannot do without the franchise is broadcast.

Angeles said that to broadcast is a privilege. The airwaves is owned by the State. If someone wants to use the airwaves, they need permission from the government.

The permission comes in the form of a franchise. This is a law.

To keep your franchise, you must follow the terms and the law.

Angeles remarked that the highest law of the land is the Constitution. The Constitution prohibits foreign ownership of a corporation with the franchise to broadcast.

Otherwise, the law can get it back by disenfranchising the violator, in this case ABS-CBN. Angeles said there is no provision in the Constitution that states anyone has the right to a franchise.

A franchise is not necessary for anyone to speak, express, publish etc..

Angeles remarked that ABS-CBN is taking us for fools if they said this is an attack of their freedom to express.

Angeles joked that even if they call Cardo (Ang Probinsyano), ABS-CBN cannot do a magic trick of a right they just invented.

As of this writing, Atty. Trixie’s FB post has gathered more than 5,200 reactions, 1,200+ shares and 698 comments from netizens.

Kailangan talaga press freedom kasi gusto nila palabasin na may KARAPATAN sila mag broadcast? Hmph.

Simplify natin.

May karapatan magsalita, magpahayag, mag express ng sarili.

Pwede magsalita, pwede magpublish, pwede mag sulat, lumikha ng sining atbp.

Pribilehiyo ang mag broadcast. Ang airwaves ay pagmamayari ng estado. Kung may nais gumamit nito, kailangan humingi ng pahintulot.

Ang pahintulot na yon, ay prankisa. Batas ito.

Para mapanatili ang prankisa, susunod sa terms ng pahintulot, at sa batas.

Ang pinakamataas na batas ang konstitusyon. Pinagbabawal nito ang dayuhan o estranghero na makibahagi sa korporasyong may prankisa mag broadcast.

Maaaring bawiin ang prankisa. Maaaring hindi ibigay. Walang batas o anumang kasulatan ang nagsasabing may karapatan ang sinuman sa isang prankisa.

Hindi kailangan ng prankisa magpahayag, magsalita o mag express ng sarili.

Niloloko tayo ng ABS kapag sinasabi nilang atake ito sa kalayaang magpahayag.

Tawagin man nila si Cardo, hindi nila mamamagick ang isang karapatang imbeimbento lang nila.
